• Assisted engineering consultant in the preparation of contracts to be presented to international bidders for a Fuel Hydrotreatment Management Project (Project Management Consultant), as well as the preparation of in site battery limit detailed engineering, in site battery limit procurement management, and the supervision of construction contracts corresponding to in site battery limit, out site battery limit and infrastructure’s EPC for the plant and facilities operation, on a lump sum, turn key (“LSTK”) basis, for a Fuel Hydrotreatment plant in Colombia.
  • Negotiated, on behalf of engineering and construction contractor, an Engineering, Procurement and Construction contract of a ~$600 million mining (copper) project in Northern Chile. The scope of work included an expansion of the coarse ore stockpile and reclaim, concentrator, the tailings pipeline and associated mechanical equipment at the tailings dam. The commercial proposal was very innovative, including a zero based fee, Key Performance Indicator (KPI) Fee (based on safety, interface with plant operations, predictability and responsiveness), Value Based Incentive bonus (based on measurable results achieved in improving Total Installed Cost, schedule and production ramp up), ramp-up bonus (based on the incremental volume of the ore throughput in excess of the ramp-up curve from the feasibility study) and bonuses based on meeting Capital Cost and Schedule targets.
  • Negotiated, on behalf of engineering and construction contractor, the Project Management Agreement for a multibillion-dollar project for the modernization of the Cantarell Field, Mexico’s biggest oil field. This project was partially financed by the Japanese EximBank.
  • Negotiated, on behalf of engineering and construction contractor, lump sum, turn key (“LSTK”) Engineering, Procurement and Construction contract for a ~$310 million Delayed Coker Project in St. Croix, USVI (for a company formes by Amerada Hess and Petroleos de Venezuela). In addition to the contract for the construction of the delayed coker unit itself, negotiated Engineering, Procurement and Construction contract for additional work, such as a delayed coke handling, storage, ship loading and marine facilities; a sour water stripper facility and an interconnecting pipeline. The total amount for the project exceeded $450 million. Among the responsibilities of the contractor were to provide all construction services, including but not limited to project management services, field construction management, construction planning and scheduling, construction cost monitoring and control, supply of direct hire field labor, supervision of direct hire and subcontract field labor, supply of construction equipment and construction of temporary and field office facilities. In addition, the scope of work required the contractor to provide subcontract administration services including bid package preparation, solicitation, analysis, conditioning, award, and supervision of those portions of the work that were to be subcontracted. This project was financed by US lenders.
  • Negotiated, on behalf of engineering and construction contractor, term sheet for an Engineering, Procurement and Construction contract (LSTK, ~US$400 million) project for a build, own and operate project in Venezuela. This also involved the preparation and negotiation of joint venture agreements to create a construction consortium. This was a non-recourse project to be financed by US lenders.
  • Negotiated, on behalf of engineering and construction contractor, the Engineering, Procurement and Construction Agreement (LSTK, ~US$172 million) project for the construction of a gas pipeline in Merida, Mexico. Among the responsibilities of the contractor were the commissioning and start-up of the facility and the purchase of all lands (including transfer of title thereto) required to complete the construction of the facility (including access to above-ground facilities). In addition, the scope of work required the contractor to be responsible for its subcontractors, which required the preparation and negotiation of Subcontract Agreements. This project was financed by US lenders.
  • Negotiated, on behalf of engineering and construction contractor, the Engineering, Procurement and Construction Agreement (cost reimbursable, ~US$243 million) for the expansion of a paraxylene facility.
  • Negotiated, on behalf of engineering and construction contractor, the Engineering, Procurement and Construction Agreement (LSTK, ~US$70 million project) for the construction of a herbicide production plant in Argentina. Among the responsibilities of the contractor were the testing, commissioning and started‑up of this self-sufficient herbicide production plant. This would require the contractor to provide all personnel, supervision, services, field labor and materials necessary for the proper construction, site development, erection and completion of the facility. In addition, the contractor was to assist the owner in procuring all necessary leases, titles, concessions, bonds, deposits, permits, licenses, easements and rights‑of‑way necessary for the construction, completion and operation of the facility, including, without limitation, construction permits, environmental permits and applicable tax waivers. In addition, the scope of work required the contractor to be responsible for its subcontractors, which required the preparation and negotiation of Subcontract Agreements.
